1. Perused the report of Reader.
2. Here it is pertinent to mention that as pointed out by Ld.
Counsel for plaintiff, the plaintiff has filed two suits titled
as
“M/s Hoshiyar Singh Suresh Chandra Sarees Pvt. Ltd.
Vs. M/s Suhagan Creation” and
“M/s Hoshiyar Singh
Suresh Chandra Sarees Pvt. Ltd. Vs. M/s Shagun
Creation”; the suit against
“Suhagan Creation” was
assigned to the Court of Sh. Anil Antil, Ld. DJ (Comm.)
and the suit against
“Shagun Creation” came to be
assigned to this court but inadvertently, the hard copy of
case pertaining to
“Shagun Creation” was filed before the
Court of Sh. Anil Antil, Ld. DJ (Comm.) and the hard copy
pertaining to
“Suhagan Creation” was filed before this
court.
3. This court has already returned back immediately the hard
copy of suit pertaining to
“Suhagan Creation”.
4. Ld. Counsel for the plaintiff has filed the hard copy
pertaining to
“Shagun Creation” today. It is evident that
said hard copy has already having initials of Sh. Anil Antil,
Ld. DJ (Comm.) in filing. Same is taken on record.

5. Issue summons of suit as well as notice of accompanying
applications (if any) to the defendant vide PF, Courier,
Speed Post, through e-mail and
dasti as well for
06.04.2026.
6. Steps be taken within next one week.
7. Plaintiff is also directed to file the affidavit of service on
the defendant.
8. Written Statement has to be filed by the defendant within
30 days
(extendable up to 120 days with the leave of the
court and subject to terms) from the date of service of
process as per amendment Proviso of Sub Rule (1) of
Order V Rule 1 CPC as applicable to the Commercial
Courts Act.
