original invoice was exhibited as Ex.PW1/18 (OSR) and the
remaining invoices were be treated as Mark-A (colly.)
FINDINGS & CONCLUSION OF THE COURT
26.I have heard learned counsel for the plaintiff, perused the record carefully
and give my thoughtful consideration to his submissions.
27.It is the case that plaintiff that the defendant was employed by the
plaintiff firm as chemical engineer from November 2022 to September,
2024 and the offer letter along with annexures dated 21.11.2022 and the
willingness of the defendant through a handwritten letter is place on
record as Ex.PW1/9 & Ex.PW1/10.
28. It is further the case that after secretly gaining the knowhow of the
business of the plaintiff, defendant suddenly resigned from his post and
thereafter started his own consultancy service in Uttar Pradesh in the
name “
BIIR Project Consultancy Services” which is deceptive similar to
the registered trademark i.e, ‘NIIR Projects Consultancy Services’ of the
plaintiff ‘s firm.
29. That the services are identical, the clientele is same thereby, and the logo
so adopted by the defendant is also similar to that of the plaintiff, which
all shall create confusion in the minds of the customers to associate the
defendant with the plaintiffs.
30. Plaintiff through the testimony of the PW-1 has duly proved on record
that the plaintiff firm was incorporated in the year 01.04.2006 and
thereafter, had adopted the trademark (Device) ‘NIIR Projects

CS (Comm) No. 311/25 Page 12 of 14
Consultancy Services’ through the copy of the certificate of registration
issued by the Registrar of the Trademarks bearing no.1544256 duly
exhibited as PW1/1 in Clause 35 which is valid till date.
31. Further, the plaintiff has also applied for registration of the trademark
(Device) in question in other classes, and holds copyright registration of
various strategy handbooks developed by the plaintiff firm, which is
evident from the copyright certificates duly issued by the competent
authority Ex.PW1/6(Colly.).
32. Plaintiff has also filed on record various invoices depicting use of the
mark “NIIR’ of various years exhibited as Ex.PW1/4 which shows the
volume of the business and promotional expenses undertaken by the
plaintiff in the succeeding years, to reflects its standing in the market.
33.Plaintiff also runs and maintains a website www.niir.org &
www.entrepreneurindia.co. depicting the nature of the services and the
background of the plaintiff firm.
34. Plaintiff has further placed on record other documents in support of his
case i.e. import -export certificate, GST Service Tax and a Certificate of
Nomination for the best 5000MSME registration certificate amongst the
other documents, including the list of clients of the plaintiff exhibited as
Ex.PW1/7 and to show the volume of the traffic at website of the plaintiff
firm as Ex.PW1/8.
35. The ‘triple identity test’ – similarity of the marks, identity of the service
and overlapping of trade channel also stands established.
-- 13 of 15 --
NIIR PROJECT CONSULTANCY SERVICES through Mrs. Veena Gupta(Sole prop.) vs.
SANDEEP KUMAR BANSLA
CS (Comm) No. 311/25 Page 13 of 14
36. As proved on record, the defendant was gainfully employed with the
plaintiffs and thereafter he started his own consultancy with the deceptive
similar names with respect to the same class of service/ goods, which
further reflects that
malafide intention and conduct on the part of the
defendant, to say that he was well aware about the trademark of the
plaintiff, its reputation goodwill and the clients so associated with it.
37. Defendant despite service has failed to appear before the Court to contest
the case. The plaintiff’s testimony has remained unrebutted and
unchallenged.
38.Comparing the two trademarks i.e. ‘BIIR Project Consultancy Services’
and that of the plaintiffs ‘NIIR’ Projects Consultancy Services, it appears
that the trademark so adopted by the defendant is deceptive similar to that
of the plaintiff trademark whereby essential features of the plaintiff’s
marks have been copied, and which is likely to cause confusion in the
mind’s of the customers/ general public.
39. The infringing activity of the defendant is also likely to cause confusion
in the course of trade of the plaintiff leading to erosion of consumer’s
trust and dilution of brand image of the plaintiff which is also likely to
cause irreparable loss to the plaintiff.
40.Appreciating the documents so proved on record including the
registration certificate of the trademark(Device) ‘NIIR’ Projects
Consultancy Services, and the fact that the impugned mark adopted by the
defendant is deceptive similar to that of the plaintiff, and the malafide
conduct of the defendant in light of his previous employment with the
-- 14 of 15 --
NIIR PROJECT CONSULTANCY SERVICES through Mrs. Veena Gupta(Sole prop.) vs.
SANDEEP KUMAR BANSLA
CS (Comm) No. 311/25 Page 14 of 14
plaintiff, the Court is of the opinion that the plaintiff is entitled to
protection.
41.Plaintiff has also claimed damages. But no evidence to show the damages
or to quantify has been placed by the plaintiff in that regard. However, to
recognize the statutory and common law rights of the plaintiff in the
trademark in question, a sum of Rs.1,000/- is awarded to the plaintiff in
that regard.
RELIEF :-
42.Thus, in light of the above discussion and analyzing the evidence so
produce before the Court, the Court is of the opinion that the plaintiff is
entitled to a decree of permanent injunction in its favour and against the
defendant, in terms of prayer Clause – a, b, c & e of the plaint, and the
defendant, its representatives, assignees etc. are hereby permanently
restrained to use the impugned trademark accordingly.
43.Plaintiff is also entitled to damages @ Rs.1,000/- as a recognition to its
rights and violation by the defendant thereto.
44. The plaintiff is also held entitled to the cost of the Suit.
45.Decree-sheet be prepared accordingly.
46.File be consigned to record room after due compliance.
