modification of the Order dated 21.07.2026 for permitting the
plaintiff to lead evidence before the Court instead of Ld. Local
Commissioner.
Present : Ms. Aarti Sharma, Ld. Proxy Counsel for Sh.
Santosh Kumar Jha, Ld. Counsel for the DH.
Defendant is ex-parte vide order dated 21.07.2026.
At this stage, Ld. Proxy Counsel appearing for the
plaintiff has pressed the application on the ground that the
plaintiff proposes to examine only its AR and the appointment of
Ld. Local Commissioner would entail substantial additional
expenses causing financial burden upon the plaintiff, particularly
when the defendant has already chosen not to contest the
proceedings. She further submits that the defendant has already
been proceeded ex-parte vide order dated 21.07.2026. She further
submits that the plaintiff undertakes to conclude its evidence
expeditiously without seeking any unnecessary adjournment.
Heard.
Keeping in view the submissions made and the facts
stated in the application, the application stands disposed off as
allowed and the appointment of Sh. Shubham Goel, Advocate,
(Enrl. No.D-1756/2020, Mob.9990492189), Chamber No. 251,
Western Wing, Tis Hazari Court, Delhi, Ld. Local Commissioner

for recording of evidence vide order dated 21.07.2026 is hereby
withdrawn.
Plaintiff is directed to examine its authorized
representative before the Court positively on the next date of
hearing.
Matter is adjourned.
Matter be listed for PE on 01.08.2026. Earlier given
date of 12.08.2026 stands cancelled.
A copy of the order be sent to the Ld. Local
Commissioner for information.
