Counsel for plaintiff has placed on record account statement of the -- 1 of 2 -- plaintiff depecting the entry of payment made by the defendant in the bank account of the plaintiff on 16.04.2022. However, in para no.10 of the plaint, the plaintiff averred that the defendant made only two further part-payments of Rs.5,000/- each on 24.04.2025 and 17.11.2025 respectively. There is no proof on record to show that the defendant made part-payments to the plaintiff on 24.04.2025 and 17.11.2025. Therefore, the plaintiff is directed to file his bank account statement showing relevant entries of payment made by the defendant on 24.04.2025 and 17.11.2025 amounting to Rs.5,000/- each, on next date of hearing, failing which appropriate order shall be passed.
