are present alongwith Ld. Counsel Sh. Rishabh Gulati.
Sh. Anil Nitin and Sh. Devender Kumar, Ld. Counsel for
the remaining defendants (except defendant no. 4).
Defendant no. 4 in person.
Vide the order dated 27.09.2023, the defence of the
defendants no. 1, 2, 4, 8 to 16 was struck off.
The matter is listed today for admission/denial
documents and framing of issues.
Affidavits of admission/denial of documents have been
filed on behalf of defendants Gopal, Rakesh, Kamla, Savita, Vandana,
Parveen, Rosy, Vicky, Laj, Indu and Raj Kumari. Copies supplied to
Ld. Counsel for the plaintiff.
Proxy counsel for the plaintiff submits that as per the
instructions of the main counsel, the plaintiff does not wish to file any
affidavit of admission/denial of documents qua the defendants no. 3, 5,
6 and 7 whose joint written statement is on record as no document has
been filed alongwith the written statement by the aforesaid defendants.
Ld. Counsel for the defendants no. 3, 5, 6 and 7 submits
that it is indeed correct that the aforesaid defendants have not filed any
documents alongwith their written statement and he contends that the
plaintiff has not filed any property document alongwith the plaint
therefore the defendants no. 3, 5, 6 and 7 do not wish to carry out any
admission/denial of documents.
