Order Details: COPY OF JUDICIAL PROCEEDINGS Pdf Text: SC No. : 171/2025 FIR No. : 10/2024 State v. Abdul Malik @ Parvez PS : Crime Branch u/s : 20/23/29 NDPS Act r/w Section 201 IPC 30.05.2025 Present: Sh. Alok Saxena, Ld. CPP for State. Sh. Akshay Bhandari, Ld. Counsel for applicant/accused Abdul Malik @ Parvez IO ASI Mahesh Kumar in person. This order of mine shall dispose off the application for grant of regular bail to the applicant / accused Abdul Malik @ Parvez. Arguments on the bail application heard and the application and IO report and the case file perused. Keeping in view the contention of applicant/accused that location chart has not been placed on record by the IO in the chargesheet and therefore, applicant/accused could not be linked to the said recovery of 5137 gms of American Ganja recovered from four parcels from foreign post office as there is no link to prove it. But, this contention has been rightly rebutted by Ld. CPP for the State on the ground that as per location chart prepared in gist by the IO from the location chart given by Nodal Officer of Mobile Company, it is very clear that the location of mobile number of applicant/accused Abdul Malik @ Parvez was matching with the location of mobile number on the said parcels. Further, the recovery of 871 gms of American Ganja from the possession of applicant/accused further corroborates the involvement of the applicant/accused Abdul Malik @ Parvez in -- 1 of 2 -- -2- the present offence. The allegations against the applicant/accused Abdul Malik @ Parvez are under Section 20/23/29 NDPS Act r/w Section 201 IPC. Further, there are allegations of committing the said offence of NDPS through dark web and through crypto currency by co-accused Mayak Nayyar and the co-accused Mayank Nayyar used to get executed the deal through present applicant/accused Abdul Malik @ Parvez who would receive and deliver the contraband to person told to him by co-accused Mayank Nayyar. Thus, the allegations are grave and serious in nature. There is every likelihood that applicant / accused Abdul Malik @ Parvez would influence/threaten the witnesses or tamper with evidence which is specifically the cyber evidence, if at liberty. So, I do not find any merit in the present application of the applicant / accused Abdul Malik @ Parvez. Hence, the present application of the applicant / accused Abdul Malik @ Parvez for grant of regular bail is hereby dismissed. Application is disposed off accordingly. This order of mine shall not effect the merits of the case. Copy of the order be given dasti to Ld. Counsel for applicant / accused. Copy of the order be sent to concerned Jail.
