Present: Sh. Rahul Rohtagi, Ld. Counsel for plaintiff along
with proprietor of the plaintiff.
An affidavit has been filed on behalf of the plaintiff
stating that the defendant is very much residing at the H.No. 163,
First Floor, Mathura Road, Hari Nagar, Ashram, Jungpura, Delhi
110014 which address is given in the memo of parties.
Summons sent to the defendant on the address of
Dev Nagar, Karol Bagh, Delhi has been received back with
report that no such person is residing at the given address.
However, in respect of the Ashram Jungpura address, report has
been received that inspite of many visits of the process server he
did not meet the process server at the given address. Let fresh
summons be issued to the defendants at the address of Hari
Nagar, Ashram, Jungpura on filing of PF/RC/speed
post/approved courier for NDOH. Steps be taken within a week.
Process Server is also directed to make verification
as to who is residing in this property or as to whom this property
belongs. Let process server appear in person on the NDOH to
apprise the court about the said fact.
Accordingly, put up on 25/09/2023. Let proprietor of
the plaintiff also accompany the process server as prayed.
Copy be given dasti to the plaintiff.
