Present: Ld. counsel for Decree Holder.
Sh. Ankit Kaushal, Ld. counsel for JD.
As per the calculation sheet filed by MCD, the total amount
due to decree holder is Rs.337146/-.
The perusal of file shows that a bankers cheque of amount of
Rs.337146/- bearing No. 135105 dated 26.05.2025, drawn on State Bank of
India is received in the name of the Decree Holder. Let the same be
released to the Decree Holder after establishing his identity against
acknowledgment subject to filing an affidavit that no separate suit or
proceedings in respect of the aforesaid amount has been filed in any other
court; that the D.H shall indemnify the J.D for the excess payment if any
and no part payment in respect of the aforesaid amount has been received
after the award of the Ld. Labour Court.
Since, the present execution petition has been satisfied,
therefore, the same stands disposed of as satisfied. The Decree Holder is at
liberty to file a fresh execution petition in respect of the interest amount, if
any.
File be consigned to Record Room as per rules.
