Defendant no. 1 has filed an application under Order
VII rule 11 CPC. Copy of the application is placed on record for
the plaintiff. Let the same be collected during the course of day.
Reply, if any, be filed within 4 weeks with advance copy to the
ld. Counsel for the defendant no. 1. Authority of Mr. Saroj
Kumar Jena, who has filed the application for defendant no. 1
under Order VII rule 11 CPC has not been filed. Let the same be
filed on or before the next date of hearing.
Put up for arguments and disposal on this
application on 15.07.2024.
Defendants no. 2, 3 and 4 have filed separate
applications under Order I rule 10 CPC seeking their deletion
from array of the parties. Defendant no. 5 has also filed a similar
application on the last date of hearing. Ld. Counsel for the
plaintiff submits that he has no objections to all these four
applications and the defendants no. 2 to 5 may be deleted from
the array of parties.
