Adjournment sought on behalf of the plaintiff on the ground that
plaintiff is suffering from the spine pain. Photocopy of an X-ray film in
this regard is filed.
Adjournment is strongly opposed on behalf of the defendants on
the ground that plaintiff is wrongfully enjoying the possession over the
suit property and has not even refunded Rs.33,00,000/- till today to the
defendant which was paid by the defendant towards the sales
consideration.
Neither any medical certificate regarding the illness of the
plaintiff nor any report of the Doctor concerned alongwith the X-ray
film placed on record on behalf of the plaintiff. Accordingly, plaintiff is
hereby burdened with the further additional cost of Rs.5,000/- to be paid
to the opposite party for delaying the case.
At this stage one application for waiver of cost imposed vide
Order dated 07.08.2025 filed on behalf of the plaintiff. However,
previous cost as well as cost imposed today is paid by the plaintiff to
the opposite party. Accordingly, present application for waiver of cost
stands disposed of.
