(c). Taken on record. It is submitted by the Ld. Counsel for the plaintiff that an application under Order XXII Rule 4 read with Section 151 CPC is pending for disposal. Perusal of the record transpires that notice of the said application was issued to the proposed LRs and as per report, all have been served on 29.10.2025. It is submitted by all the three proposed LRs present in Court today, that other than them no other legal heir of Smt. Daropati i.e. deceased defendant no. 2 is available. In view of this, the application under Order XXII Rule 4 readwith Section 151 CPC is allowed and the LRs of deceased defendant no. 2 are taken on record.
