1. It is averred in the application that applicant/accused is law
abiding citizen of India and has been falsely implicated in this
case and he is running in judicial custody.
2. It is also averred that investigation is complete, charge-
sheet has already been filed, trial will take its own time and
charge has already been framed.
3. It is also averred that applicant/accused is having clean
antecedents, statement of only eye-witness shows that deceased
herself has attempted to commit suicide and applicant/accused
tried to save her life and there is no intention or motive attributed
to applicant/accused.
4. It is also averred that applicant/accused undertakes to
appear on each and every date and also undertakes to abide by
the terms and conditions imposed by the Court and will not
abscond or tamper with evidence, if granted bail and will furnish
sound surety. It is thus prayed that the applicant/ accused be
granted bail.
5. On the other hand, Ld. Addl. PP for the State duly assisted
by the IO has vehemently opposed the present application on the
ground that allegations are serious in nature and material
witnesses are yet to be examined. It is further submitted that there
is apprehension that applicant will flee from justice on being
released. He prays for dismissal of the application.

6. I have heard the submissions and perused the record
carefully.
7. Perusal of the record reveals that applicant is charged with
the offence under Section 302/201 IPC and matter is at the stage
of PE.
8. Perusal of the reply filed on behalf of the IO reveals that as
per the allegations, applicant/accused committed murder of his
wife by inflicting multiple injuries on her body and thereafter,
washed the floor of the premises in order to remove the blood
stains lying over there. It further reveals that deceased sustained
at least 14 injuries on her body and eye-witness is the minor
daughter. It further reveals that after murder, applicant/accused
eloped from the scene of the crime in the morning in the presence
of public witnesses and he wanted to abscond to Nepal. It further
reveals that his blood stained clothes have been recovered. It
further reveals that there is apprehension that applicant/accused
can jump the bail, can tamper with the evidence and can
influence the witnesses on being released.
9. In view of the aforesaid facts and circumstances,
considering the gravity of offence, seriousness of the
allegations levelled against the applicant/accused, role of
applicant/accused, fact that material/public witnesses are yet to
be examined, apprehension that applicant/accused can tamper
with the evidence, can influence the witnesses and may jump the

bail on being released and finding force in the submissions made
by Ld. Addl. PP for the State and reply of IO, this Court is not
inclined to enlarge accused/applicant Mukesh Kumar Mandal on
bail at this stage. Accordingly, the present bail application
stands dismissed and disposed of.
10. Needless to say, the above-mentioned observations are
predicated solely on the facts as alleged, and brought forth at this
juncture, and are not finding on merits, and would also have no
bearing on the merits of the case.
Copy of this order be sent to SHO concerned for
information. Copy of this order be given dasti to the Ld. Counsel
for accused as well as to the Ld. Prosecutor for record.
