Remaining defendants except the defendant no. 21
are ex-parte.
Defendant no. 21 is yet unserved.
Amended memo of parties has been filed on behalf
of the plaintiff in compliance of the order dated 17.10.2023.
Copies supplied to Ld. Counsel for the opposite parties.
Ld. Counsel for the plaintiff has also placed on
record the cost deposit receipt of Rs. 1,000/- in compliance of the
order dated 17.10.2023.
Ld. Counsel for the defendants no. 16 to 20 submits
that the cost of Rs. 5,000/- imposed upon them shall be paid to
the plaintiff during the course of the day. Be so paid.
Ld. Counsel for the plaintiff further submits that she
does not wish file replication to the WS of the defendants no. 16
to 20.
In view of the submissions made, the opportunity of
the plaintiff to file the replication of the WS of the defendants no.
16 to 20 stands closed.
The summons issued to the defendant no. 21 have
not been received back. Let fresh summons of the suit and

notice of the application U/o 39 Rule 1 and 2 CPC be issued
to the defendant no. 21 on filing of PF/RC/Speed Post by the
plaintiff. Steps be taken within 7 days.
The defendant no. 21 to file the written statement
within the statutory period.
Parties to also file the affidavits of admission/denial
of documents by the next date of hearing with advance copy to
the opposite party.
Put up for appearance of the defendant no. 21, filing
of affidavits of admission/denial of documents, completion of
pleadings and arguments on the application U/o 39 Rule 1 and 2
CPC on 07.05.2024.
