Present transfer petition has been filed under Section
24 CPC seeking transfer of suit bearing CS SCJ NO. 1784/2017,
titled, ‘Daya Ram vs Meera Devi’ along with counter claim
bearing Misc SCJ No. 34/2021 titled as ‘Meera Devi vs Daya
Ram’ pending before the court of Sh.Milan Goel, Ld. Civil
Judge-08, Central to the court of Sh.Tarun Yogesh, Ld. District
Judge-13, Central, Tis Hazari Courts, Delhi where suit bearing
no. CS DJ 2971/2017 between the same parties is pending trial.
Considering the application, for the sake of judicial
convenience, in order to conflicting judgments and to save
precious judicial time and since the parties are same and property
in question is also same, it is appropriate if matters are to be
adjudicated by the same court. However, the question of
consolidation of both the cases would be decided by the court
concerned.

Accordingly, suit bearing CS SCJ NO. 1784/2017,
titled, ‘Daya Ram vs Meera Devi’ along with counter claim
bearing Misc SCJ No. 34/2021 titled as ‘Meera Devi vs Daya
Ram’ are withdrawn from the court of Sh.Milan Goel, Ld. Civil
Judge-08, Central and are transferred to the court of Sh.Tarun
Yogesh, Ld. District Judge-13, Central for adjudication and
disposal as per law.
Parties to appear before the court of Sh.Tarun
Yogesh, Ld. District Judge-13, Central on 28.05.2026.
Ahlmad of Transferor court is directed to send the
files to Transferee court immediately.
Copy of order be sent to both the courts for
compliance.
Transfer application is accordingly disposed of and
be consigned to the record room.
