Affidavit qua admission/denial of documents stand filed on
behalf of parties. Proposed issues also stand filed on behalf of parties.
From the pleadings of parties, following issues stand framed.
1. Whether the defendants are the owner of the property by way
of adverse possession? OPD.
2. Whether the status of the defendant qua suit property was of
a licensee? OPP.
3. If issue No.1 & 2 are decided in favour of plaintiff, whether
the plaintiff is entitled for the decree of possession? OPP.
4. If issue No.1 to 3 are decided in favour of plaintiff, whether
the plaintiff is entitled for decree of Permanent Injunction in
his favour? OPP.
5. If issue No.1 to 4 are decided in favour of plaintiff, whether
the plaintiff is entitled for decree of Mesne profit/Damages
and if yes, at what rate and for which period? OPP.
6. Relief.
No other issue arises.
Let list of witnesses be filed within 15 days with advance
copy to other party. Affidavit in lieu of PE be also filed on or before next date
of hearing with advance copy to opposite party.
Put up the matter for PE now on 15.09.2025.
