Present : Ld counsel for parties.
Matter is today fixed for arguments on the application u/o 39
Rule 1 & 2 CPC moved on behalf of plaintiff whereby a prayer has been
made for restraining the defendant from creating any third party interest
in the suit property i.e property bearing No. 962, situated in Ward No. VI,
Gali Patna Wali, Haveli Hisamuddin Haider, Ballimaran, Delhi-110006
till pendency of trial.
However, on the other hand, it is fairly submitted by the
counsel for defendant that without prejudice to his right and contention
during the pendency of trial his party is ready to make an undertaking to
the effect that he will not create any third party interest in the suit
property detrimental to interest of the parties, till the disposal of the suit.
Accordingly, application u/o 39 Rule 1 & 2 CPC stand
disposed of with a direction to the parties to maintain the status quo qua
the suit property.
Signature of plaintiff No.1 & 2 as well as defendant are
taken on order sheet w.r.t their undertaking duly identified by their
counsels.
It is also made clear that nothing stated in this order shall
tantamount to an opinion on merits of the case.
Put up the matter for admission/denial of documents as well
as for framing of issues now on 30.07.2025.
