Praveen Singh, Ld. Counsel for all defendants. It is stated that an application is pending seeking impleadment of defendant no.2 in its individual capacity after attaining age of majority. Arguments heard. 2. It is stated that defendant no.2 turned major on 14.12.2023, therefore, aforesaid prayer has been made. However, an objection has been raised by the opposite side that accompanying affidavit of the application is not in accordance with Order 32 Rule 2 (iii) CPC. This is a technical defect and in view of the substantial prayer, this court does not find any legal impediment to allow the said application when the defendant no.2 already turned major. Accordingly, the present application is allowed. Defendant no.2 will now act in its individual capacity. 3. Fresh vakalatnama on behalf of the Defendant no.2 filed today. Ld. Counsel seeks time to consult with the defendant no.2 whether he wants to adopt previous WS filed by his mother or he wants to file fresh WS. 4.
