    Sarita Jain v. Anita Gupta
    11.02.2025
Fresh RCT Appeal is received. It be checked and
    registered.
Present : Sh. Yashwant Singh, Ld. counsel for appellant.
The order impugned is dated 09.01.2025 vide which
cost of Rs.25,000/- is imposed upon the appellant being
respondent before the Ld. Trial Court. Ld. counsel for the
appellant submits that cost is the only grievance of the appellant.
This is an interlocutory order. In Central bank of
India v. Shri Gokal Chand: AIR 1967 SC 799, the Supreme
Court held that though the language of Section 38 of the Act may
seem to suggest that an appeal lies against all or any order of the
learned Rent Controller, however, no appeal would lie against
any interlocutory order which are merely procedural and do not
affect the rights and liabilities of the parties.
The order imposing cost is an order interlocutory in
nature. Accordingly the present appeal is held to be not
    maintainable. Same is thereby dismissed.
Appeal file be consigned to Record Room.
