Report of Civil Nazir perused.
Ld. Counsel for DH at this stage submits that neither movable
nor immovable assets of JD are situated within the territorial jurisdiction,
she requests for issuance of transfer certificate to the DH for the Petition to
be filed before the appropriate forum i.e. Thrissur, Kerala.
The present execution petition is for execution of the Judgment
dated 24.09.2024. In view of the request of Counsel for DH, it would be
appropriate to transfer the present execution petition to the Court of
competent jurisdiction where JD is residing/having its assets.
A Transfer Certificate be issued to the DH for presenting the
instant execution petition before the proper forum having jurisdiction for
execution of the decretal amount.
