WS as well as an application seeking condonation of
delay is filed on behalf of defendant. Time is sought on behalf of plaintiff
to file reply of application seeking condonation of delay.
On behalf of defendant, it is submitted that in the
application seeking condonation of delay of 80 days whereas it is delay
of 90 days and request is made that condonation of delay be considered
for 90 days.
Further, during the course of submissions, it is submitted
that present suit has been filed on the basis of finding of Central
Administrative Tribunal. It is stated that the said order is under challenge
before the Hon’ble High Court of Delhi. It is also apprised that there are
certain orders of stay by Hon’ble High Court of Delhi and against that
order, stay has been granted by Hon’ble Supreme Court of India.
Since the suit is admittedly filed on the basis of finding
of CAT and those findings admittedly are under challenge, put up the
matter for consideration on maintainability of suit at this stage.
Put up on 07.01.2027 for consideration on the
application and filing of WS as well as issue of maintainability.
