Despite waiting since morning, none has appeared on behalf of defendant. Perusal of the record shows that accompanying the leave to defend application, an application u/s 5 of the Limitation Act has been filed seeking condonation of delay of a period of 30 days in filing to leave to defend application. Even on the LDOH post lunch session nobody had entered appearance on behalf of the defendant. Although the callous conduct of the defendant does not warrant any indulgence in so far as application u/s 5 is concerned and as stated nobody has appeared on behalf of the defendant despite repeated calls since -- 1 of 2 -- morning. However in the interest of justice and subject to a cost of Rs 4,000/- last and final opportunity is granted to the defendant to address arguments on the application u/s 5 of the Limitation Act. It is made clear that in case the arguments are not addressed on the NDOH or the defendant does not appear on the NDOH the application u/s 5 of the Limitation Act shall be dealt with in accordance with law without any further opportunity. Re-notify the matter for further proceedings on 27.03.2024. (Sachin Sood) ADJ-01 (Central) THC, Delhi/06.03.2024 -- 2 of 2 --
