(through VC).
Sh. Yogesh Sharma, Ld. Counsel for both of the
defendants.
It is submitted by Ld. Counsel for the defendants
that prior to the date fixed for hearing i.e. today, an application
under Order VII Rule 10 and 11 read with section 151 CPC has
been moved on behalf of the defendants as the suit premises in
question is admittedly being used exclusively for commercial
purposes and present court does not have the subject matter
jurisdiction to deal with the present matter.
Copy of the application be supplied to the other side.
Defendant is directed to place on record the copy of said
application for supply to the other side. Further, the application
under Order 1 Rule 10 read with section 151 CPC has been filed
by one applicant Sanjeev Jain alongwith Vakalatnama. It is seen
that the applicant has mentioned in the application that the
application is being moved on behalf of the plaintiff, which is
apparently incorrect.
The applicant is at liberty to move an appropriate
application and take appropriate measures for correction of
typographical error if any, in the application.
