JDs no.1 & 2 are unserved.
Matter is today fixed for filing of fresh address of
JDs. However, no fresh address has been filed.
A week’s time is sought to file the fresh address of
JDs.
Heard.
One last and final opportunity is granted to the DH
subject to costs of Rs.5,000/- to be deposited with DLSA, Central
District in case DH fails to file the fresh address of JDs within a
week.
On filing of fresh address, issue notice of the
execution to the JDs no.1 & 2 on filing of PF and RC/Speed Post
and approved Courier. Notice be also issued through approved
electronic mode.
Steps be taken within a week. Nazir shall issue the
notice within three days of receipt of process and if DH fails to
take the steps within a week, on deposit of a cost of Rs.5,000/-
with DLSA, Central District, process be issued if the step is taken
at least seven days before the next date of hearing failing which
the execution shall be dismissed for non-prosecution.
The JDs are at liberty to file objection, if any, as per
law and not beyond 30 days from the date of service.
