Matter is today fixed for report of service upon JDs/
appearance/filing of objections, if any. However, no steps have
been taken.
At this stage, it is submitted on behalf of the DH that
JDs have started making the payment of Rs.25,000/- per month
and are still residing at the given address.
Heard. As per record, JDs have not been served yet.
On filing of affidavit regarding the correctness of
address proof of the JDs, let the fresh notice be issued to the JDs
on filing of PF and RC/Speed Post and approved Courier. Notice
be also issued through approved electronic mode. Mobile No., if
any, be also mentioned on the processes.
Steps be taken within a week. Nazir shall issue the
notice within three days of receipt of process and if DH fails to
take the steps within a week, on deposit of a cost of Rs.5000/-
with DLSA, Central District, process be issued if the step is taken
at least seven days before the next date of hearing failing which
the execution shall be dismissed for non-prosecution.
The JDs are at liberty to file objection, if any, as per
law and not beyond 30 days from the date of service.
As prayed, be put up for report of service/filing of
objection, if any on 19.09.2025.
