JD in person alongwith Sh. D.P.S. Guliyani, Advocate.
Heard. File perused.
DH has filed self attested copy of his Aadhar card in
proof of his identity. Same is taken on record.
JD has paid balance amount of Rs. 1,50,000/-, out of the
first installment amount of Rs. 4 lacs, to DH today. Let the signature
of DH be obtained in side of the previous proceedings, in token of
having received the said amount.
It is jointly submitted that the parties have arrived at
settlement before Delhi Mediation Center, THC on 19.8.2025 for a
total sum of Rs. 22,00,000/- towards full and final satisfaction of the
present execution petition, as per terms and conditions mentioned in
clause No. 5 thereof and also that the JD has paid the first installment
of Rs. 4 lacs to DH. It is further submitted that the remaining settled
amount of Rs. 18 lacs is payable in six equal monthly installments of
Rs. 3 lacs each payable on 25th day of English Calender month
commencing from 25.9.2025 onwards and the last installment shall by
payable on or before 25.2.2026. In view thereof, DH has requested to
dispose off the execution petition in terms of said settlement, however,
with liberty to get it revived in case of default in payment of any of
the future installments by JD.

In view of above, separate statements of DH as well as JD
have been recorded today.
Both the parties shall remain bound by their respective
statements.
At this stage, DH has requested not to dispose off the
present execution petition today. He submits that the present execution
petition be disposed off once JD makes payment of second installment
of Rs. 3 lacs payable on 25.9.2025.
In view of above request made by DH and in the interest
of justice, request is allowed.
Put up on 25.9.2025 at 2.00 pm for further payment and
for passing appropriate directions.
