Heard. File perused.
At the outset, counsel for DH has informed that no
amount whatsoever has been paid by JD to DH after last date.
JD seeks pass over till 2.00 pm for his appearance, as also
to pay part amount of Rs. 2 lacs to DH.
Accordingly, the matter is directed to be listed at 2.00 pm.

Heard. File perused.
JD has not appeared in the Court even now, despite his
assurance and on his request to keep the matter at 2.00 pm.
On instructions, Ld. Counsel for the JD has stated, at Bar

that part payment of Rs. 40,000/- has already been transferred in the
account of DH, which submission is not disputed by DH.
Further, Ld. Counsel for the JD states, at Bar that JD shall
also transfer atleast a sum of Rs. 1,60,000/- in the account of DH
either today or positively by tomorrow.
On oral request and keeping in view the submissions
made by counsel of JD that JD has gone to his bank concerning
withdrawal of proceeds of his FDR, he is personally exempted from
appearance for today. However, he is hereby granted last and final
opportunity to appear personally before the Court on the next date.
In the interest of justice, JD is hereby granted last and
final opportunity for filing reply of application seeking his arrest and
detention in civil imprisonment, moved by JD, positively by next date,
with direction to supply advance copy thereof to the opposite side,
failing which no further opportunity shall be granted for the said
purpose.
Calculation of amount becoming due, the payments
received from JD and the balance outstanding amount, is filed on
behalf of DH. Copy supplied.
Put up on 22.7.2025 at 2.00 pm for appearance of JD,
further payment, reply if any and arguments on the aforesaid
application.
Date is given as per the mutual convenience of both the
sides.
