This is an execution in respect of a decree dated
19.04.2011. It is stated that RFA no. 431/2011 against the said
decree is already pending disposal before the Hon’ble High Court
of Delhi and the DH herein has given a statement on 30.04.2011
that he shall not get the decree executed during the pendency of
the appeal. However, since the JD is deliberately delaying the
disposal of the appeal, he has withdrawn his undertaking before
Hon’ble High Court of Delhi with permission of the court. Copy
of order dated 12.12.2025 in this regard is placed on record. The
same is perused.
Since the present execution petition has been filed
after more than two years, notice has to be issued to the JD.
However, it is submitted that the property involved in the matter
pertains to the area of Vasant Kunj, Delhi which comes in the
jurisdiction of Ld. Principal District & Sessions Judge, New
Delhi District, Patiala House Courts, Delhi. It is requested that
the Transfer Certificate be issued.
In view of the submissions made, Transfer
Certificate be issued as prayed, as per rules.
