As per the mediation report, the matter is reported as non-settled.
As recorded vide order dated 18.01.2024, it was submitted that the plaintiff would
not be conducting admission/denial of documents.
The affidavit of admission/denial of documents by the defendant was taken on
record as recorded vide order dated 18.05.2024.
With the consent of the parties, following issues are framed for adjudication :-
1. Whether the plaintiff is entitled to a decree of cancellation of the documents
i.e. GPA, Agreement to Sell, Affidavit, Possession Letter, Will and Receipt all
dated 19.11.2017 in respect of property falling in Khasra no. 21/22/1, in Village
Burari, Delhi known as B Block, Kaushik Enclave, Burari, Delhi? OPP
2. Whether the plaintiff is entitled to a mandatory injunction whereby directing
the defendant to handover the GPA, Agreement to Sell, Affidavit, Possession
Letter, Will and Receipt all dated 19.11.2017? OPP
3. Whether the plaintiff is entitled to a decree of permanent injunction in respect
of the suit property thereby restraining the defendants etc. from selling or
creating third party rights or interests in the suit property ? OPP
4. Relief.
No other arises or is pressed for.
List for PE on 10.02.2025.
Both the parties are directed to file their respective list of witnesses and also the
evidence by way of affidavit of all the witnesses proposed to be examined and the counsel for the
plaintiff is directed to file the list of witnesses alongwith the evidence of all the witnesses
proposed to be examined on or before the NDOH with advance copy to the other side atleast 7
days prior to the NDOH.
